Youth sports league liability expert

What a league, club or tournament was required to do, and whether it did it.

A youth sports league liability expert explains what a league, club or tournament was required to do under its governing body's rules and the state's youth concussion law, and whether it did it. Ron Kramer covers soccer, hockey and lacrosse organizations.

Questions a league liability expert answers

  • Policies and rules. Did the organization have the policies its governing body requires, and follow them?
  • Concussion and return to play. Every state has a youth sports concussion law. Maine's (20-A M.R.S. §254(17)) requires removal of a student suspected of a concussion and written clearance from a trained health care provider before return. Did the league follow its procedures?
  • Officials. Did the league assign enough officials, certified for that level?
  • Coach screening and training. Were coaches trained and certified as the governing body requires?
  • Facilities and equipment. Were fields, rinks, goals and boards safe and inspected?
  • Tournaments and events. Scheduling, rest between games and on-site medical coverage.

How engagement works

Ron works only through the attorney on the case. A first call covers the incident, the level of play and your deadlines, at no cost. Ron then reviews the records, gives a verbal assessment, writes a report if you want one, and testifies at deposition and trial in any state.

Common questions

Does every state have a youth sports concussion law?

Yes. Washington passed the first, the Zackery Lystedt Law, in 2009, and by 2014 all fifty states had one. The details differ by state. Ron reviews whether the league's procedures met the law that applied.

What does Maine's school concussion law require?

Maine requires schools to adopt a concussion policy, remove a student suspected of a concussion from play, and bar return until written clearance from a licensed health care provider trained in concussion management.
